Vietnam’s Draft Digital Industry Law

On the 3rd of July 2024, the Vietnamese government released a draft of the Digital Industry Law for public consultation. The draft law promises to bring about a fresh change in hi-tech areas such as AI, big data, cloud computing, Internet of Things, etc. The law encourages the development of the digital sector of the economy through governmental policies and incentives for the private sector such as funding for R&D programs, exemptions from certain taxes, development of a hi-tech workforce, sandboxes, etc.

Especially, the draft also dedicates a section to the regulation of AI. In this section, the draft encourages the development and application of AI and at the same time mandates the drafting of ethical guidelines and principles for AI. More notably, this section also includes provisions banning certain types of AI such as those that manipulate human behavior, discriminate against certain groups of people, and classify and evaluate people based on their social activities or personal characteristics, etc. The provisions also suggest a classification system to manage AI risks and require a marking to identify AI-generated digital products. All of these provisions are rather reminiscent of those in the recently passed EU’s AI Act.

In all, the draft Digital Industry Law shows that Vietnam is very interested in the development of its digital sector and hi-tech applications. Considering the rise of new and innovative technologies in recent years, especially AI, the passing of a law to regulate and support the development of the digital sector is much needed. However, it remains to be seen how the final draft of the law will be and what impacts it will have once implemented.
